1.      The Workplace Health and Safety Act 1995 does not apply to homeowners working on their own
 homes.

  1.  However, if the homeowner contracts someone to do work that involves removing fibro, then that
     contractor has a legal obligation (under the Workplace Health and Safety Act 1995) to ensure they do
     not endanger their own health and safety or that of the home occupants or neighbours.
  2.  You don't need a special asbestos contractor to remove fibro sheets. Any builder can do the job as long
     as safety procedures are followed. (However, for other forms of asbestos removal a person holding an Asbestos Removalist Certificate must be engaged.) If you have any concerns about the removal process, you should contact any Workplace Health and Safety office.
  3. The Workplace Health and Safety Advisory Standard for the Safe Treatment, Removal and Disposal of Asbestos-Cement Sheeting and Asbestos Coated Metal Sheeting provides a useful guide for contractors and homeowners who are removing fibro sheeting.
  4. The standard gives guidance on how to reduce the likelihood of dust being generated when removing or handling fibro, as well as how to more and dispose of this material.

Licencing



From 1 July 2006, removal of 10m2 or more of bonded asbestos can only be done by a holder of a new 'B' class licence.

'B' class licences are issued to applicants who can demonstrate they are familiar with the practices and procedures for removing bonded asbestos set out in the asbestos removal code.

Competency can be demonstrated by:

  • producing a certificate for asbestos removal work issued under the Workplace Health and Safety Regulation 1997 before 1 February 2002
  • producing a statement of attainment issued by a registered training organisation for a course which covers competencies for the removal of bonded asbestos material as set out in Code of Practice for the Safe Removal of Asbestos 2nd Edition [NOHSC:2002(2005)]
  • passing an exam assessed by an authorised accredited provider or registered training organisation.

A person who removes less than 10m2 of bonded asbestos material does not require a licence, however, that person must be competent and comply with the practices procedures and requirements set out in the asbestos removal code.
